Blue Bell named in another lawsuit

(AP) – A Galveston County woman has filed a lawsuit against Blue Bell Creameries, alleging she became ill after eating ice cream contaminated with listeria.

Ursula Burton claims in the lawsuit, filed this week in a Galveston County district court, that on April 18, 2015, she purchased Blue Bell ice cream for herself and her daughter at a convenience store.

The petition alleges that later that day both Burton and her daughter “became violently ill and started to vomit.”

Burton claims she was diagnosed with listeriosis and is now lactose intolerant. She claims her daughter also has developed dairy sensitivity.

Burton is accusing Blue Bell of gross negligence and deceptive trade practices in the suit. She is seeking $200,000 to $1 million for pain, anguish, medical expenses, damages from physical impairment and lost wages.

Blue Bell officials have declined to comment on pending litigation.

Blue Bell in 2015 shut down all its production facilities and recalled all of its ice cream products over listeria concerns.

Earlier this month, a lawsuit claiming a consumer became ill was filed in Fort Bend County.
